TERMS AND CONDITIONS FOR SUBMITTING PHOTOS/VIDEOS FOR THE LAND.COM NETWORK

BY SUBMITTING PHOTOS/VIDEOS TO US, YOU CONFIRM THAT YOU HAVE READ AND AGREED TO THESE PHOTO/VIDEO SUBMISSION TERMS AND CONDITIONS.

The Land.com Network extends to Land.com, LandWatch.com and LandAndFarm.com.

Photos and videos are invaluable tools in marketing rentals to customers. The two elements that are essential for having effective photos or videos in your listing are the Quality and the Content of photos and videos. Here are some tips to ensure that your listing contains the best photos/videos.

PHOTO QUALITY

  • Orientation– Photos on the Land.com network of websites (“Site”) work best when they are shot horizontally, or in landscape mode. The image should completely fill the space from edge to edge. Images that are upside down or at awkward angles will not be accepted.
  • Resolution– Land.com recommends all photos be at least 2,048 pixels on the longest side in order to ensure high quality presentation for both users on desktops and on mobile devices. Photos that are less than 2   .048 pixels on the longest side may be rejected. Any logo files should be no less than 80 pixels in height and 380 pixels in width. Reinforcement advertising should be exactly 762 pixels in width by 125 pixels in height. In order to determine the size of your photos please follow these steps:
  • PC Users:Right click on the image file and select properties.
  • Mac Users:While clicking on the image, press Option, then select Get Info.
  • Format– Images must be submitted in JPG or PNG   format.
  • Unacceptable Elements– When determining which photos to include in your listing, do not include images that are distorted, blurry or contain unrecognizable elements. Images that contain any special effects, such as strobing, flashing or animation, or not allowed on the site.

VIDEO REQUIREMENTS

  • Recording Method– Videos on the Site should be recorded so the video is displayed horizontally. The party recording the video shall make every effort to provide a high-quality video.

PHOTO/VIDEO CONTENT

  • Original Work– All submissions shall be owned by the party submitting the images/videos. Images/videos that infringe on any copyright or trademark will not be accepted.
  • Superimposed Content– Text, graphics or logos superimposed onto the image/video is not permitted on the Site. Images or videos that display phone numbers, email. addresses or website URLs will be deleted.
  • Spyware/Malware– All submitted images/video must not be contaminated or infected with any viruses, malware, or any other corruption that is either intended to damage or may result in damage to the Land.com computers and systems. Images/video must not use tactics intended to circumvent any Land.com listing review process or other enforcement systems.
  • Illegal/Adult Content– All submitted images/videos must not promote illegal products, services or activities. Images/videos will be rejected and removed if they encourage or promote discriminatory behavior against federally protected classes. Images/videos encouraging the use of tobacco products, e-cigarettes, prescription or recreational drugs, weapons and ammunition are not permitted. No adult-oriented images/videos or images/videos promoting legal or illegal sexual acts are permitted.

By submitting Images/Videos or User Information to us, you further agree that:

  • We may moderate the Site, review all submitted images/videos, and decide in our sole discretion whether to display or otherwise use your images/videos.
  • We may remove your images/videos from the Site at any time without notice to you.
  • We may edit your images/videos in our sole discretion for suitability and compliance with our rules and any other purpose we deem appropriate.
  • You are solely responsible for your images/videos and the consequences of submitting them to us and our use thereof as permitted by these terms.
  • You acknowledge that you were not and will not be compensated or granted any consideration by use or any third party in exchange for our use of your images/videos or the use of your images/videos by parties we authorize to use them.
  • You hereby grant to Land.com, its affiliates, and its parent and related companies a royalty-free, perpetual, irrevocable, nonexclusive, fully transferable, fully sublicensable right and license to copy, modify, display, distribute, perform, create derivative works from, store, and otherwise use and exploit all such images/videos in any form, media, software or technology of any kind now or existing or developed in the future. By submitting your video to the Site, in addition to the rights, licenses and privileges referred to above, you are also granting Land.com and its affiliates the unqualified, unconditional, unlimited, royalty free right, license, authorization and permission to use and refer to your name, image, characteristic or other distinctive identification in relation to your video, for any purpose whatsoever, without any compensation to you, in products or services developed by Land.com or its affiliates, without limitation or restriction whatsoever.

You affirm, represent and warrant to us:

  • You are at least 18 years old.
  • The images/videos you provide to us are true and accurate.
  • You haven't impersonated any person or falsely stated or misrepresented your affiliation with a person or entity.
  • Your agreement to submit images/videos to Land.com does not in any way conflict with any existing legal agreement or commitment on your part to any third party.
  • Your images/videos do not embody, reflect or reveal any confidential information and that we are not obligated to treat them as confidential.

Claims of Copyright Infringement

Land.com and its affiliates respect the intellectual property rights of others, and asks those posting or transmitting any Images/videos to or through the Site to do the same. If you believe that your work has been copied and/or infringed on the Site, you may notify Land.com according to the notice requirements of the Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(2) (“DMCA”) by sending the following information to Land.com’s DMCA Registered Agent either by mail to CoStar Realty Information, Inc., Attn: General Counsel, 1331 L Street, NW, Washington, D.C. 20005; by email to copyright@costar.com; or by calling (202) 346-6500:

  • A description of the copyrighted work that you claim has been infringed;
  • Identification of the material you claim is infringing, including a description of where such material is located;
  • Your address, telephone number, and email address;

A signed statement that the information in your notice is accurate, that you have a good-faith belief that the identified use is not authorized by the copyright owner, its agent, or the law, and under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner’s behalf.

LAND.COM, ITS AFFILIATES AND THEIR RESPECTIVE THIRD-PARTY LICENSORS DO NOT MAKE ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING YOUR SUBMISSION OF IMAGES/VIDEOS. LAND.COM, ITS AFFILIATES AND THEIR THIRD-PARTY LICSENSORS IS NOT LIABLE TO USE OR ANY THIRD PARTY IN ANY WAY FOR YOUR SUBMISSION OF IMAGES/VIDEOS TO THE SITE. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, LAND.COM, ITS AFFILIATES AND THEIR RESPECTIVE THIRD-PARTY LICENSORS SPECIFICALLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE ACCURACY AND NON-INFRINGEMENT. LAND.COM DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF SUCH INFORMATION. LAND.COM RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO CORRECT ANY ERROR OR OMMISSION ON THE SITE OR IN THE CONTENT.
